Camilla was instructed to defend the Managing Director of a successful property company in respect of a prosecution for a House in Multiple Occupation licensing offence for an alleged breach of section 72(1) of the Housing Act 2004. The issues in the case concerned corporate identity and his company’s vicarious liability for the acts of senior management. After advising on evidence and drafting lengthy written representations, the local authority withdrew the prosecution against Camilla’s client, despite his previous convictions for HMO licensing offences.
