Another success for Islam Khan at the Court of Appeal

On Tuesday 1 July, Islam Khan appeared before Lord Justice Dingemans, Justice Saini and His Honour Judge Hirst in the Court Of Appeal Presidents’ courtroom.
His client who had a serious history of breaches of SOPO, and a heavy antecedent prior to 1980, was sentenced for breach of notification requirements and breach of SOPO totalling 28 months consecutive by Inner London Crown Court last year.
Leave to appeal was granted this year by J Cavanagh, that the judge at Inner London Crown Court failed to consider the totality guidance when sentencing Mr Khan’s client.
In his judgement LJ Dingemans commended “Mr Khan for his written and oral submissions to assist the court” and agreed with his submissions to set aside the 28 months sentence of his client and resentence with a 20 months concurrent sentence.
After the hearing, Mr Khan’s client who had heart and kidney disease was emotional and thanked the panel of judges for their justice. LJ Dingemans acknowledged this.
