Colin Witcher Secures Acquittal on Double Attempted Rape

Mr Witcher secured after a five day trial, the acquittal of a young defendant who faced two charges of attempted rape (with sexual assault in the alternative) together with an allegation of non-fatal strangulation.

The defence advanced was fabrication as to the suggestion of restraint and violence, and consent as to all sexual acts, notwithstanding the defendant had initially denied any interaction had taken place and was unknown to the complainant. 

The trial was made complex by the defendant being illiterate (both in his native tongue and English) and the cultural difficulties of explaining concepts of sex and similar. 

The defendant was acquitted of all counts faced. Mr Witcher was instructed by Sunita Mehta, Partner at ABV Solicitors
