Colin Witcher successfully obtains damages for unlawful arrest and false imprisonment

Colin Witcher April 3, 2025

Colin Witcher was retained on behalf of Ms X, a highly respected professional, who was wrongfully arrested for breach of an alleged order and thereafter detained at the police station. The alleged order did not exist, the allegation made was false and advanced by Ms X’s ex-partner falsely using a different order which gave no powers of arrest.

A carefully constructed pre-action letter prepared by Colin and Anna Ford, the instructing solicitor, resulted in an immediate no-fault settlement being offered by the relevant police force offering financial compensation and an assurance of learning lessons: together with recovery of costs. The case was motivated not by the desire to secure damages, but to improve greater understanding and training to stop genuine victims being turned into suspects.

Colin was privately instructed and greatly assisted by Anna Ford of Shearman Bowen Solicitors.
