Jibreel Tramboo successful at judicial review hearing at the Administrative Court

Jibreel Tramboo has successfully obtained permission for judicial review for his client at a hearing at the Administrative Court, before Deputy High Court Judge Matthew Butt KC.
The claimant, Mr Afridi, was detained by police alleging that he was not undertaking his studies and working over 20 hours. He was served a Red.0001 Notice to inform him of his liability of removal.
The permission for judicial review focused on whether it was arguable for the claimant that the defendant committed errors in the service of the Red.0001 Notice. The notice did not contain a cancellation of leave, and the defendant accepted that the claimant was enrolled for his studies.
The question was whether the defendant would inevitably reach the same conclusion in the Red.0001 to cancel leave. However, as cancellation for an alleged breach of working hours results in discretionary cancellation and not automatic, and there being an error in the Red.0001 Notice, the Court concluded the claimant’s case on all grounds as arguable and granted permission for judicial review.
Jibreel was instructed by Asim Suleman of Lawfare Solicitors.
