Spanish extradition murder case dropped

George Hepburne-Scott’s client has been discharged on a Spanish Warrant issued by a Judge-Magistrate “Investigating Court 13 of Malaga” in “Preliminary Proceedings” in the case of Spain v C.A.
Working with the phenomenal Magdalena Motyl of Bark & Co, the defence instructed Dr Jaime Campaner of Campaner Law an expert of Spanish law and extradition who sought to investigate the Court file in relation to whether a formal decision to prosecute had been made. Arguments were developed under s.12A of the Extradition Act 2003 in this regard.
Following this, the defence team worked alongside the requested person’s retained Spanish lawyer, Rafael Jiménez de Vicuña Urbieta and also engaged the services of Woodcock Notary Public Services to officiate various documents for the Spanish authorities.
The net result of all these efforts was that the Spanish authorities decided to withdraw the Extradition Arrest Warrant that had ben issued pursuant to the Trade and Co-Operation Agreement, and which contained two allegations of Attempted Murder, and the requested person was subsequently discharged in the extradition proceedings by an Order of Westminster Magistrates’ Court, dated 13 April 2026
