Successful Defence of Romanian Extradition Request on Article 8 Grounds

We are pleased to report a successful outcome for George Hepburne-Scott in a contested extradition case. Following a contested extradition hearing on 3 June 2026 in Romania v D.G., the Requested Person was discharged by Westminster Magistrates’ Court.

The case concerned a Romanian extradition request seeking the enforcement of an outstanding sentence of 1 year and 9 months’ imprisonment arising from driving offences committed in 2016. The defence relied upon extensive medical evidence concerning the Requested Person’s cancer diagnosis and ongoing treatment.

The District Judge rejected the defence case under section 25 of the Extradition Act 2003, finding that assurances provided by the Romanian authorities regarding the availability of appropriate medical treatment in custody were sufficient. However, the court accepted that, in light of the Requested Person’s medical condition and personal circumstances, extradition would amount to a disproportionate interference with his Article 8 rights.

The Requested Person was therefore discharged from the extradition warrant.

The case involved detailed consideration of the interaction between serious ill health, state assurances, and the proportionality assessment required under Article 8 of the European Convention on Human Rights.

This was an excellent result for the client and his family, who were understandably relieved by the outcome.
