Colin Witcher comments on the use of AI generated material in court, in City AM

Colin Witcher has provided comment in City AM on the risks around using AI-generated legal material in court, and how greater scrutiny should be applied when using this technology in the legal profession.
“The risks of AI should hardly need explaining to lawyers, but it appears from recent events that even the legal profession is not immune from placing undue trust in this technology.
“AI may be a tempting starting base, but the emphasis is on the word “starting”. The results generated by AI must and should be carefully examined. The risks are not simply that incorrect legal principles are cited, but also that entirely fake cases by way of authorities are generated. Failing to identify this not only risks personal and professional embarrassment, but may also incur the wrath of regulators.
“As barristers, we are instructed for our tactical insight, legal knowledge and our mastery of facts – not our ability to use Google.
“AI may, when properly used, have a purpose in litigation – such as case management, key word searches, and the mirroring of documents. It may even have a purpose in policing. However, AI cannot safely replicate human thought and analysis, and failing to acknowledge this places everyone at risk.”
